2. No Guarantee of Uninterrupted or Fully Secure Operation
XRG provides managed IT, cloud, and cybersecurity services designed to materially reduce risk and improve reliability. However, no monitoring service, security control, assessment, migration, or hardening engagement — no matter how thorough — can guarantee that a system, network, or organization will be immune from downtime, human error, or compromise. The technology and threat landscape changes continuously, and a finding-free assessment reflects the state of a system at a specific point in time, not a permanent guarantee.
3. Point-in-Time Nature of Assessments
Security assessments, configuration reviews, infrastructure audits, and similar engagements reflect the systems, configurations, and information available at the time the work was performed. New vulnerabilities, misconfigurations, or failure modes may emerge after an engagement concludes. Continued protection and reliability typically require ongoing monitoring, patching, and periodic re-assessment — which is why XRG structures most engagements as continuing managed services rather than one-time projects.
4. Limitation of Liability
To the fullest extent permitted by applicable law:
- XRG, its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, this website.
- XRG's total aggregate liability for any claim arising from this website will not exceed the total fees, if any, paid by you to XRG for the services giving rise to the claim in the twelve (12) months preceding the event giving rise to the liability.
- Nothing in this section limits liability where such limitation is not permitted under applicable law (for example, liability for death or personal injury caused by negligence, or fraud).
For client engagements, liability terms specific to the engagement are governed by the signed statement of work or managed services agreement, which take precedence over this general website disclaimer.
5. Third-Party Services Disclaimer
This website relies on third-party infrastructure, including hosting and content delivery (Cloudflare) and web font delivery (Google Fonts). XRG is not responsible for outages, security incidents, or data handling practices of these third parties that are outside our direct control, though we select providers with reasonable care.
6. No Warranty
This website and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement, except as expressly stated in a signed client agreement.
7. Indemnification
Where applicable and set out in a signed client agreement, each party's indemnification obligations are as defined in that agreement. This website-level disclaimer does not itself create indemnification obligations beyond what is agreed in writing.
8. Force Majeure
XRG will not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including natural disasters, acts of government, internet or infrastructure outages, or large-scale cyberattacks against third-party providers.
9. Severability
If any provision of this page is found to be unenforceable, the remaining provisions will continue in full force and effect.
